2. Subject matter of the contract

The subject matter of the contract is a remote medical assessment: the doctor reads your answers and decides whether the document can be issued.

We do not sell medicines and we do not guarantee that a document will be issued. The decision rests with the doctor alone and may be negative, in particular where a physical examination is required.

3. The doctor

The assessment is carried out by lek. Damian Wojno, a doctor holding a valid licence to practise the profession in Poland (licence number 3211301, OIL Olsztyn).

Important: the doctor is registered in Poland and is not registered with the Medical Council of Malta. The doctor's professional practice is governed by Polish professional law.

4. Services and prices

Prices are stated in euro and include tax.

  • Repeat Prescription - 24,90 €
  • Weight Loss Treatment - 29,90 €
  • Contraception - 24,90 €
  • Priority handling - +9,90 €

5. Formation of the contract

By submitting the form together with payment you place a binding order. The contract is concluded when we send you an email confirmation with your order number - please keep it.

6. Payment

Payments are handled by Stripe Payments Europe, Ltd. We never see or store your full payment card details.

7. What the fee covers and when we refund

The fee is payment for the doctor's assessment and is not the price of a document. The assessment is treated as performed even where it ends in a refusal to issue the document.

  • Where the doctor refuses on medical or legal grounds, we refund the full amount.
  • If we ask you for documents or further information, you have at least 7 days to reply; if we hear nothing we send a reminder, and we extend the deadline at your request. If the assessment still cannot be completed, we close the order and refund the full amount. We always write to the address you gave us.
  • Where the details you gave are incorrect or incomplete and the assessment is impossible for that reason, we ask you to correct them in the same way; if the assessment cannot be completed, we refund the full amount.

We refund using the same means of payment; depending on your bank, crediting the money may take a few working days.

8. What we do not prescribe

Narcotic and psychotropic substances are excluded from cross-border prescriptions (Article 11(6) of Directive 2011/24/EU). In addition, by our own decision we do not prescribe benzodiazepines, Z-drug hypnotics, opioids, stimulants or gabapentinoids.

If your request concerns such a substance, the form warns you before payment is taken and the order will not be accepted.

9. Delivery of the document

If the doctor decides to issue the document, you receive it by email as a PDF prepared in accordance with the model set out in the Annex to Implementing Directive 2012/52/EU.

Warning: it is the pharmacy that decides whether to dispense the medicine. A prescription issued in another Member State may be refused, for example where the medicine is not available in the country or where there is any doubt. We therefore cannot guarantee that it will be dispensed.

10. Cancellation

As a consumer you have the right to cancel the contract. The conditions and a model form are set out on the Cancellation page.

This right ends earlier once the service has been fully performed, where performance began at your express request and you acknowledged that you would lose that right (Article 16(a) of Directive 2011/83/EU and the national law transposing that Directive into Maltese law). You give that acknowledgement in the order form.

11. Complaints

Please send complaints to info@medinow.app, quoting your order number. We reply within 14 days.

12. Liability

The service does not replace emergency medical care. In an emergency call 112 or contact an out-of-hours doctor.

We are not liable for harm arising from incorrect details supplied by you.

13. Governing law and dispute resolution

The contract is governed by Polish law. You retain the protection afforded to you by the mandatory consumer protection provisions of the country of your habitual residence (Article 6(2) of Regulation (EC) No 593/2008 - Rome I).

We are not bound by any out-of-court dispute resolution code. This does not limit your statutory rights, including your right to bring proceedings before a court.
